The decision by the judge in Virginia that the mandate to force people to buy Obamacare in unconstitutional is great news. Of course we all knew Obamacare was unlawful, but we do need the courts to protect us. What other goods and services could the government force us to buy if this were allowed to stand?
Stalling any and all implementation is essential. We will lose doctors immediately once doctors find they can no longer pay their overhead and keep their offices open.

74% Docs Intend to Flee Obamacare
The impending draft of American physicians into a communist system of health "care" has the majority of them making other plans. Are you telling me that free men don't want their businesses and professional skills stolen from them?

CAIR Bears excluded from Obamacare, pssst, don't offend them!
"Muhammad better not be depicted anywhere in this drawing of us CAIR Bears, or we will cut off your head and murder you in the street. Also, we will murder you if you make us suffer under Obamacare with everyone else. We have many other excuses for wanting to murder you, too. Admiral Akbar!"
Can someone with a solid knowledge of the misunderstood CAIR Bears that are Muslims tell us whether these people purchase renters’, homeowners’, and car insurance in America?
Obama deliberately setup page 107 of Obamacare to specifically exclude Muslims from having to either purchase insurance under Obamacare or suffer the severe financial penalties for noncompliance of the mandate.
His reasoning was that the misunderstood CAIR Bears of the “religion of peace” can’t buy insurance because “that is gambling” and it is item #17,876,543 of “Things That Offend Islam and Require Beheading and Death of Those Who Offend Islam”.
I'm liking the Hillbuzz ideas here.

Obama Admin Threatens to Destroy Insurers Who Criticize Obamacare
The gangsters have spoken. Kathleen Sebelius sent a letter to insurers last Thursday telling them they had better stop blaming rate increases on Obamacare, or they will be excluded from insurance exchanges starting in 2014, when the government monopoly on health care begins. After that, the Health Secretary will be responsible for approving all policies sold in the United States. According to the Obama Administration, there shall be no free speech for insurance companies. You vill toe the party line, and YOU VILL LIKE IT! Sebelius stated that "there will be zero tolerance for this type of misinformation and unjustified rate increases." So, unfunded mandates are OK, but complaining about them is VERBOTEN!
Washington Examiner states, "The threat to use government regulation to destroy or harm someone's business because they disagree with government officials is thuggery. Like the Obama administration's transfer of money from Chrysler bondholders to its political allies in the United Auto Workers, it is a form of gangster government."
Oh, don't worry. There is no government takeover of Health Care. Sen. Kent Conrad says so.

Zero tolerance for expressing an opinion, or offering an explanation to policyholders? They’re more subtle than this in Caracas. …More here.
This is nasty stuff and an obvious attempt to shift political blame for rising insurance costs before the election. It’s also an early sign of life under ObamaCare, when all health-care decisions are political and the bureaucrats decide who can charge how much for a service or product.
Oh, don't worry. There is no government takeover of Health Care. Sen. Kent Conrad says so.

Primary Day, Remember Who Voted For Obamacare: Complete List
Voting today? Voting soon? Voting in NOvember?
Let's make it a Hell NOvember for the fans of Obamacare. Yes, Obamacare. The gift that keeps on giving. American employers are already scared to hire new workers, in good part because of the burdens of Obamacare. Additionally, the 1099 reporting requirements will crush small business under an avalanche of tax paperwork. Can you imagine sending a 1099 form to Staples or the computer store? Yep. Wherever you spent more than $600, you will have to send a 1099 tax form, after scrambling around to find out the taxpayer ID number for each of these retail outlets. Nightmare!

Hat Tip RWNJ.Now that the damage has been done everyone wants to know who needs to be held accountable in November. Below is the list of the 219 representatives that voted to pass this disasterous piece of legislation. Note that 34 Democrats joined every Republican in voting against it. Isn’t it nice to see that Obama is keeping his promise of ending partisanship? We actually had bi-partisan resistance to the bill, that’s certainly a step forward, right?

Arizona Tells Employees Health Insurance Will Skyrocket
State and university employees with families can expect to see their monthly health-insurance costs rise as much as 37 percent next year, depending on the type of plan they choose.
Figures provided by the Arizona Department of Administration show that health plans for families and single adults with children will shoulder the most-expensive monthly premium increases beginning Jan. 1, while individuals will pay modest increases.
The Department of Administration cited federal health reform as the reason the state's health plans will carry "greater expenses and higher premiums for members," according to a June 30 letter sent to about 135,000 state and university employees and their dependents.
The letter named two provisions that the state expects will drive health-insurance costs higher. One is a requirement that insurance plans provide coverage for dependent children up to age 26. The other is the federal legislation's ban on lifetime limits, an insurance-industry practice that cuts coverage once an individual's medical expenses exceed a set amount over their lifetime.

Physicians Sue To Stop Obamacare
I have to tell you that I have wondered why physicians didn't speak out more loudly against Obamacare this past year. I still don't understand why the American Medical Association endorsed it. I understand that the AMA represents less than 30% of all physicians. But why would they sell out their members so completely. Almost like the AARP endorsement throwing seniors under the bus. As if someone has been Bought Off.
To actually DO something about Obamacare, I suppose they had to wait until it became law. And now the AAPS, the Association of American Physicians and Surgeons, has filed suit in U.S. District Court for the District of Columbia (AAPS v. Sebelius et al.).
“If the PPACA (Obamacare) goes unchallenged, then it spells the end of freedom in medicine as we know it,” observed Jane Orient, M.D., the Executive Director of AAPS. “Courts should not allow this massive intrusion into the practice of medicine and the rights of patients.”
“There will be a dire shortage of physicians if the PPACA becomes effective and is not overturned by the courts.”
The PPACA requires most Americans to buy government-approved insurance starting in 2014, or face stiff penalties. Insurance company executives will be enriched by this requirement, but it violates the Fifth Amendment protection against the government forcing one person to pay cash to another. AAPS is the first to assert this important constitutional claim.
The PPACA also violates the Tenth Amendment, the Commerce Clause, and the provisions authorizing taxation. The Taxing and Spending power cannot be invoked, as the premiums go to private insurance companies. The traditional sovereignty of the States over the practice of medicine is destroyed by the PPACA.
I hope the physicians and the 14 states that are suing against Obamacare are successful. There are other ways to reform health care without gutting the best health care system in the world.

Oh Great. Another Summit.
Obama stated yesterday, in one of his rare (not) public appearances, that he want Republicans to come to the White House later this month for a "bipartisan" healthcare summit. Obama refuses to scrap his 2000+ page healthcare-destruction leviathan and start over. This leads me to think that he is not interested in doing what Americans want, which is to enact common-sense reforms, tweak the system, while preserving the greatest health care in the world. No. Obama insists on holding fast to the deals he cut with trial lawyers, big PhRMA , unions and lawmakers. In fact, I think the Democrats are the only ones who could put forth a plan that includes fines and jail time, and call it an entitlement.
House Republican Leader John Boehner said that it is not that Americans do not understand Obama's plan. Americans do understand the plan, and we don't like it.
If Obama were serious about healthcare reform, he would sit down with Republican lawmakers and start over. A modest bill could address issues of pre-existing conditions, tort reform and insurance portability. I'm not going to hold my breath.

Do We Get To Take A Deep Breath?
I don't know about you. But I, for one, have a new attitude since Scott Brown was elected Senator of Massachusetts. I have been terrified this entire year that Obama would be able to inflict lasting harm onto our nation. Obamacare would have been the worst. The government infrastructure set up to oversee our health care would have harmed that industry greatly. Irreparably.
Also Cap and Tax. And amnesty for illegals. Can it be possible that our politicians will now be able to defend us in Washington? Because, honestly, we have been virtually defenseless through all of 2009. What an awful year that was. Americans protested. Washington politicians cackled, "Ha, ha! Let's ram it through before they can stop us!" Americans called, faxed, emailed and tweeted. Politicians sneered, "Those people calling and writing are fringe elements. They are extremists."
And that is what is so beautiful about what happened in Massachusetts. By electing Scott Brown as the 41st Republican vote, Americans, ordinary Americans showed exactly WHO is upset at the Radical Obama Agenda. Independents and Republicans completely rejected the Obama agenda. And also 20% of Democrats. That is a large group of people. I wonder if the forecasters can take those results and plug them in nationwide for a look at what November 2010 might look like. I hear rumblings on the internet that if the Massachusetts Miracle holds true, Democratss will lose their large majority in congress.
You don't say. You mean you can't sneer at and laugh in voter's faces for a full year an face no consequences?
The best news is that Scott Brown's election brings November's bounty home a little early. Kind of like Christmas in July. November in January. So Happy 2010 my fellow Americans. I have a good feeling about this.

Liberal Billionaire Regrets Voting For Obama
Obama punted on the economy and reversed the fortunes of the Democrats in 365 days.
He’s misjudged the character of the country in his whole approach. There’s the saying, “It’s the economy, stupid.” He didn’t get it. He was determined somehow or other to adopt a whole new agenda. He didn’t address the main issue.
This health-care plan is going to be a fiscal disaster for the country. Most of the country wanted to deal with costs, not expansion of coverage. This is going to raise costs dramatically.
In the campaign, he said he would change politics as usual. He did change them. It’s now worse than it was. I’ve now seen the kind of buying off of politicians that I’ve never seen before. It’s politically corrupt and it’s starting at the top. It’s revolting.
Five states got deals on health care—one of them was Harry Reid’s. It is disgusting, just disgusting. I’ve never seen anything like it. The unions just got them to drop the tax on Cadillac plans in the health-care bill. It was pure union politics. They just went along with it. It’s a bizarre form of political corruption. It’s bribery. I suppose they could say, that’s the system. He was supposed to change it or try to change it.
Even that is not the worst part. He could have said, “I know. I promised these things, but let me try to do them one at a time.” You want to deal with health care? Fine. Issue No. 1 with health care was the cost. You know I think it was 37 percent or 33 who were worried about coverage. Fine, I wrote an editorial to this effect. Focus on cost-containment first. But he’s trying to boil the ocean, trying to do too much. This is not leadership.

Chris Matthews Predicts Scott Brown Win
There is a reason that this is one of the only MSNBC videos ever to be posted on this blog. There is some satisfaction watching the pundits shake their heads. Bellweather polls show Brown leading by double digits. And I even found myself agreeing when they said that Brown was leading, not because of Republicans, but in spite of Republicans.
When will they get it. Voters are DONE with party politics. We are voting for the candidate. Based on RECORD. Not WORDS. And the majority of Americans, including those living in Massachusetts, oppose Obamacare, Amnesty and the rest of the Government Takeover Agenda.

Can Nullification Weaken the Gov't Takeover of Healthcare?
I have to tell you that I am not a political science major. In college I majored in biology. So many of these terms are new to me. Do any of you know about Nullification? Is it true that this might be a way to fight this battle?
More here at Tenth Amendment Center.
The real way to resist DC is not by begging politicians and judges in Washington to allow us to exercise our rights…it’s to exercise our rights whether they want to give us “permission” to or not.
Nullification – state-level resistance to unconstitutional federal laws – is the way forward.
When a state ‘nullifies’ a federal law, it is proclaiming that the law in question is void and inoperative, or ‘non-effective,’ within the boundaries of that state; or, in other words, not a law as far as that state is concerned.
It’s peaceful, effective, and has a long history in the American tradition. It’s been invoked in support of free speech, in opposition to war and fugitive slave laws, and more. Read more on this history here.
Regarding nullification and health care, there’s already a growing movement right now. Led by Arizona, voters in a number of states may get a chance to approve State Constitutional Amendments in 2010 that would effectively ban national health care in their states. Our sources here at the Tenth Amendment Center indicate to us that we should expect to see 20-25 states consider such legislation in 2010.
20 States resisting DC can do what calling, marching, yelling, faxing, and emailing has almost never done. Stop the feds dead in their tracks.
For example, 13 states are already defying federal marijuana prohibition, and the federal government is having such a hard time dealing with it that the Obama administration recently announced that they would no longer prioritize enforcement in states that have medical marijuana laws.
Better yet, in the last 2+ years more than 20 states have been able to effectively prevent the Real ID Act of 2005 from being implemented. How did they do that? They passed laws and resolutions refusing to comply with it. And today, it’s effectively null and void without ever being repealed by Congress or challenged in court.
While the Obama administration would like to revive it under a different name, the reality is still there – with massive state-level resistance, the federal government can be pushed back inside its constitutional box. Issue by issue, law by law, the best way to change the federal government is by resisting it on a state level.

Citizen Questions Jim Himes About Pelosicare Vote
This lady asks good questions about the constitutionality of requiring folks to buy insurance and punishing them with $25K fines or 5 years imprisonment. Congressman Himes (D-CT) repeats Democrat talking points. He claims to have read the 2000-page bill line by line.

Several Hurdles Remain to Health Care Legislation
I have to tell you, the wind really came out of my sails yesterday. Sometimes ignorance is bliss. I saw on Twitter someone said that of the bills opened up for debate in the senate such as the Reidcare bill, over 97% end up being approved by the Senate. Can that be TRUE? Oh no. And this is such a DOG of a bill. So much intrusion into our personal lives. I am hoping that this bill is different, because it is such a high profile case. Here are the final hurdles it must pass before going into law.
Times Online.
Eventually, Harry Reid will bring the Bill to “cloture” — the critical step where the Senate will vote to end the debate. Mr Obama needs 60 votes here to defeat a Republican filibuster. This will be the most important vote of the entire process.
If he manages to defeat a Republican filibuster with 60 votes, the Senate votes on final passage of the Bill. Only a simple majority — 51 votes — is needed.
The House and Senate must then appoint members to a “conference committee” from each chamber, which will meet to reconcile the House and Senate Bills into one piece of legislation.
Sixty votes will again be needed to stop Republicans blocking the appointment of such a committee.
If differences are reconciled the committee produces a “conference report” — the final version of the legislation. It is debated again in both chambers but cannot be amended.
Sixty votes are again needed in the Senate to bring the debate to cloture and to move to a final vote. If each chamber votes to pass the final legislation it goes to Mr Obama for signature.

Sen Lieberman's Home is Under Siege by the Left
In an event held by the "Interfaith Fellowship for Universal Health Care" a "prayer vigil" was held outside of Joe Lieberman's Strawberry Hill Ave. apartment building in Stamford, Connecticut on November 15, 2009. Their people estimate about 475 in attendance. They marched from the Stamford High School to pray and chant outside of Joe Lieberman's home.
The protestors are angry because Sen. Lieberman has stated that he plans to join Republicans in a filibuster of the Obamacare bill. Lieberman does not want to put the debt this bill would cause onto his children and grandchildren. Lieberman said he won’t block efforts to begin the debate, but he will filibuster a public option to end the debate.
Please click this link and send letters/faxes/emails of support to Sen. Lieberman. We can't allow intimidation tactics by the left to be the only voice he hears.

Reid Lobbying Senators For H C Vote This Weekend--Politico
With an assist from Joe Biden, Senate Majority Leader Harry Reid scrambled Wednesday to pull together 60 votes for his health reform bill, awaiting all-important cost estimates in hopes of getting the bill to the floor by the weekend.
At around 2:15 p.m., the three moderate Democratic holdouts - Blanche Lincoln, Mary Landrieu and Ben Nelson - entered Reid's office for a briefing....
As expected, moderates were the focal point. Salazar ate lunch with Sen. Mark Pryor (D-Ark.) in the Senate dining room. Lincoln (D-Ark.) hustled into the Senate reception room for a sitdown with Biden, but she emerged without making any public commitments....
Reid said Tuesday that he is "cautiously optimistic" he can secure the 60 votes he needs to move forward on the bill by this weekend. Reid's bill is expected to include a national government insurance plan with a provision for states to opt out. Reid is also expected to adjust a 40 percent excise tax on high-value insurance plans by raising the threshold at which insurers would pay the fee. He's expected to make up for that lost revenue by proposing an expansion of the Medicare payroll tax.

Now remember, this is the health care bill that nobody has read. It has not been release. It is NOT the Pelosicare bill. I have to tell you it is SO frustrating that something so important and far-reaching for Americans is being subjected to back-room wrangling, lobbying, and possible threats/bribes. Oh, I mean "earmarks" and promises of a Democrat primary challenge if they don't go along. Is this any way to do the business of governing our country? Is this what our founders wanted from the Federal Government? That they would tell us how to live and die? Say it isn't so!
Please contact your senator THIS WEEK. Your life may depend on it.

Even Socialists are Against Obamacare
Politics are odd. Here are legions of conservatives, fighting daily proposals for more government intrusion in our lives. And you would think at least somebody would be happy about these developments. Like maybe avowed Socialists or Communists. But no. The Socialists at Socialist Web Zine are urging their members to protests Obamacare as it stands. Still not Socialist enough, in their minds. And it is instructive to see their reasoning. There is education to be had for us "mom and pop" type Americans who are not exposed to pure Socialist thought in our daily lives. This is what the Socialists are decrying about the Pelosicare bill:
Notice how they said "immigrants" instead of Illegal Immigrants? This is inaccurate.
I agree that the Medicare cuts are particularly cruel.
It just struck me odd to see this article. I thought they, at least, would be happy to see the proposed destruction of so large a segment of the capitalist system.
The primary problem with HR 3962 and the Senate proposals is that all of the changes they propose are made within a for-profit system. The House Bill strips the insurance companies of the right to deny coverage based on a pre-existing condition. Yet, it de-links the public option from Medicare reimbursement rates, thereby surrendering pricing to the private sector. The Bill removes the anti-trust exemption enjoyed by private insurers. However, it simultaneously mandates that all Americans carry some form of health insurance, thereby herding millions into low-coverage high-fee private plans. Each step in a positive direction is coupled with a restructuring that will enrich private insurance companies and pharmaceutical makers.
The bills lost further reform credentials as Democrats cut last minute deals with Republicans. Immigrants were removed from eligibility for the public option, abortions were written out of the proposal and Medicare funding was cut. The Medicare cuts are particularly cruel, since they will reduce an already compromised plan to bare bones coverage. Some of the cuts will limit private insurance profiteering, but others will slash necessary items such as exercise programs for seniors. Overall, these omissions signal that the reforms are not about providing comprehensive medical coverage, but about political expediency within the establishment political class. The next round of negotiations in the Senate is sure to produce even further regressive measures as campaign-donation driven legislators cut more deals.

Could Health Care Get Bogged Down in the Senate?
Consider this.
The Senate and the House have been devising entirely separate bills on healthcare reform. Although the House has approved a bill, the Senate has not. With sharp differences of opinion among top Democrats in the Senate hampering the approval of a specific bill, the Senate has been tied up in committee sessions, closed-door meetings, and endless consultations with special interests, in order to somehow come up with a bill that will at least partially satisfy everyone involved.
Reid believes that he finally has a bill that will satisfy most Democratic Senators, but no one has seen it, and top Republicans are complaining that they have been totally shut out of the process.
It is this mysterious bill that will be placed on the Senate floor for debate this week. But remember, even if such a bill passes, which is highly doubtful, healthcare reform will still not yet become law.
